This is a personal injury case study involving our client, Kate Hendrix *, a senior woman, who experienced injuries to her feet. This case study uses information from the settlement brief and other materials collected throughout her claim.
INTRODUCTION AND DETAILS OF ACCIDENT
In, 2010, our client Kate Hendrix entered a department store, and shortly after encountering a piece of store equipment, both of her feet were injured. Our client reported the accident immediately and the wounds on both feet progressively got worse overtime. Kate already suffered from a disease that made her extremely vulnerable to infections even from minor wounds. Following this incident, our client began to suffer more dramatically as her foot wounds were misdiagnosed multiple times, resulting in a horrible infection. Our client had to go through extensive treatments to try and cure the infection. Kate’s injuries impacted her family as well as her ability to walk. Approximately a year and a half after the accident, Kate contacted Ashley Gnyś.
DETAILS OF ACCIDENT
Our client walked into the department store and asked an employee if she could use something made available by the store that helped people with mobility difficulties. The employee then led Kate towards the area where these mobility scooters were available. The employee began to maneuver it out for our client when suddenly it ran right over top of Kate’s feet. Our client reported the accident and received clinical care for her injuries days after the incident.
IMPACT OF INJURIES
The injuries caused by this accident have filled Kate’s life with multiple physical and emotional challenges. The physical injuries included her to become entirely immobile and not being able to walk, which eventually led to mental distress. Our client also had to unfortunately minimize her involvement in the lives of close family members due to her immobility. As a result of this accident, the injuries she had suffered changed her life in ways that could only be improved with the help of her lawyer Mr. Ashley Gnyś.
During the five year legal process that Kate was heavily involved in, the insurance adjusters and the opposing party put up a constant fight. The department store continually refused to release any video and security footage of the accident. Although these challenges were present, the full support and assistance from Ashley Gnyś permitted Ms. Peterson to receive a settlement of approximately $100,000.00. She continues to thank Ashley and his team for supporting her through the entire process, and changing the negative aspects of her life into positive memories that Kate and her family can now enjoy.
