Neck and Back Injuries from a Car Accident

This is a personal injury case study involving our client, Joe Simpson *, who was involved in a drunk driving car accident. This case study uses information from the clientʼs settlement file.

INTRODUCTION

Joe Simpson was an average teenager that enjoyed life as a high school student. Unfortunately, our client’s life took a turn for the worst when he was a back seat passenger in an alcohol related car accident. The accident took place late one night in the summer of 2009. The country roads were wet, but the young person who was driving the vehicle continued to speed and had been drinking before getting behind the wheel. The driver began to perform reckless stunts on the road, losing control of the wheel and at a very high speed, this person drove right into a tree. There was no time to brake. Joe, along with the other passengers in the car, were hit and severely injured.

The vehicle was completely totaled and the back seat passengers were trapped for over an hour before the paramedics could remove them from the car and transfer them to the ambulance. When Joe regained consciousness, he remembers his friend laying on his lap and Joe was covered in her blood. His friend was riding in the passenger seat and suffered life threatening injuries. Joe does not recall all of the accident as he was in and out of consciousness from the time the car hit the tree to being admitted into emergency. This traumatic experience not only caused physical injuries to Joe, but the horrible flashbacks of the event, had emotionally took over his entire life. Close to two years after the accident, Joe decided to retain Ashley Gnyś to help get his life back on track.

IMPACT OF INJURIES

The physical injuries that Joe suffered due to the accident are long term and needed extensive medical care and treatments.  Joe suffered mild brain injuries, along with knee and leg injuries due to his lower body getting crushed by the passenger seat in front of him. He also got a concussion and whiplash which spiraled into neck injuries and a back sprain.

Experiencing a bad accident at such a young age made Joe’s physiological injuries very severe. He was diagnosed with post-traumatic syndrome and suffered with anxiety and mental stress from the time of the accident. All of Joe’s injuries drove him away from school, work and any kind of social life. The accident made him a completely different person that was on a long road to recovery. Ashley Gnyś and his team began to work with Joe to get the compensation and treatment that would help him recover as fast as possible.

OUTCOME

Joe’s case took four to five years to settle, but was well worth the wait. With the full cooperation from Joe and the work of Ashley and his personal injury team, a settlement was reached in mediation for just under $200,000.00. This settlement will ensure that Joe’s daily needs are met, and will also greatly improve his quality of life and health recovery.
